1. About these terms

This website, mannabrew.co.nz, is operated by Marula Distributions Limited, trading as MannaBrew NZ. “We”, “us” and “our” refer to Marula Distributions Limited.

These terms apply to your use of our website and purchases from our online store, together with our Shipping, Refund, Cancellation, Payment and Privacy Policies.

We sell in trade. Nothing in these terms excludes or restricts rights that cannot lawfully be excluded under the Consumer Guarantees Act 1993, Fair Trading Act 1986, Privacy Act 2020 or other applicable law.

If a provision conflicts with a mandatory legal right, that right prevails.

2. Using our website and accounts

You must be at least 18 years old or use our website with the consent of a parent or legal guardian.

Provide accurate and current information when ordering or creating an account.

Keep your login details secure and contact us if you suspect unauthorised access.

3. Products and descriptions

We aim to describe products, quantities, ingredients, packaging and availability accurately.

Screen settings and packaging updates may affect appearance, but goods must still match their description and meet applicable consumer guarantees.

Please follow the preparation and storage instructions supplied with the product.

We may update our range and product information. Changes do not reduce our obligations for orders already accepted.

4. Orders

Placing an order is an offer to purchase the selected goods. We accept your order when we send an order confirmation email.

We may decline an order before acceptance for a legitimate reason, such as unavailable stock or suspected unauthorised payment. Any payment received for a declined order will be refunded.

If a problem arises after acceptance, we will contact you and resolve it consistently with your legal rights and our Cancellation Policy.

Please contact us separately about wholesale supply or commercial resale.

5. Prices and payment

All prices and delivery charges are in New Zealand dollars.

Marula Distributions Limited is not currently registered for GST. No GST is charged, and we cannot issue a GST tax invoice.

The total price, including delivery, is displayed before you confirm payment.

Price changes do not affect accepted orders. If an obvious pricing error occurs, we will notify you promptly and address it in accordance with applicable law. We will not increase the amount charged without your agreement.

6. Delivery

We deliver within New Zealand under our Shipping Policy.

Delivery estimates include the processing and transit periods stated in that policy. They are not guaranteed delivery dates unless we expressly agree otherwise.

Where we arrange delivery, we are responsible for addressing delivery failures. Contact us if an order is missing, damaged or significantly delayed.

Events outside our control do not remove your statutory rights. Where a substantial delay occurs, we will discuss an appropriate remedy, including a refund or revised delivery where applicable.

7. Cancellations

Cancellation requests are covered by our Cancellation Policy.

8. Returns and refunds

Our Refund Policy explains our voluntary 30-day change-of-mind offer and the remedies available for faulty, damaged, unsafe or incorrectly supplied goods.

The change-of-mind conditions do not limit your statutory rights.

9. Consumer guarantees and business purchases

Where the Consumer Guarantees Act applies, our goods must meet its guarantees, including acceptable quality, matching their description and fitness for applicable purposes.

A business purchase does not automatically exclude the Act.

Any separate agreement to contract out must satisfy the Act’s requirements, including supply and acquisition in trade, a written agreement and terms that are fair and reasonable for the parties to be bound by.

These terms do not themselves contract out of the Act.

10. Intellectual property

Website content, including text, photographs, graphics, logos and product materials, belongs to Marula Distributions Limited, Dune Foods (Pty) Ltd or the relevant rights holder.

You may use the website for personal shopping and other uses permitted by law.

You must not reproduce or commercially exploit protected content without permission from the relevant rights holder.

11. Reviews and feedback

Reviews and testimonials must reflect genuine experiences. You must not submit misleading reviews or content that infringes another person’s rights.

If you submit content for publication, you permit us to display it for that purpose with your chosen display name, subject to applicable privacy rights.

A verified-purchase label is used only where the purchase has been checked. Reviews from other sources must not be presented as verified purchases from our store.

Where a review involves a free sample, incentive or another material connection, that connection must be disclosed. We do not require a positive review in exchange for an incentive.

We may moderate unlawful, abusive, misleading, irrelevant or privacy-infringing content. We do not remove a review simply because it is negative or edit it to change its meaning.

12. Prohibited use

You must not use our website to:

• Break the law or infringe another person’s rights.

• Submit fraudulent orders or unauthorised payments.

• Upload malicious code or interfere with website security.

• Access accounts or information without permission.

• Publish misleading, abusive or unlawful content.

We may restrict access where reasonably necessary to address misuse. This does not remove our obligations for valid orders or your statutory rights.

13. Shopify and external services

Shopify provides the technology supporting our online store. Your purchase contract is with Marula Distributions Limited.

Our website may link to external websites or services. Those services have their own terms and privacy practices.

We remain responsible for our own obligations, including those relating to services we engage to fulfil your order.

Our store is hosted by Shopify, which processes personal information when you visit or purchase from our store. 

We have enabled Shopify Network Intelligence, which allows Shopify to use information from your interactions with our store, other merchants and Shopify to provide enhanced services, including personalisation and relevant advertising. Information is shared with Shopify and other service providers, which may be located outside New Zealand. 

These activities are subject to applicable consent requirements and privacy choices. Our Privacy Policy explains this processing, overseas disclosures and how to exercise your privacy choices.

14. Privacy

Our Privacy Policy explains our collection, use, sharing and protection of personal information.

It also explains access and correction rights and how to raise a privacy concern.

15. Liability

Nothing in these terms limits a remedy or compensation available under applicable consumer law.

Where consumer guarantees apply, you retain the right to claim reasonably foreseeable loss resulting from a failure to meet those guarantees.

To the extent permitted by law, we are not responsible for losses arising solely from your unlawful use of the website or circumstances for which we have no legal responsibility.

16. Complaints and disputes

Contact contact@mannabrew.co.nz with your order number and a description of the issue.

We respond to enquiries within three business days and will work with you to resolve the matter.

You may also seek information from Consumer Protection, bring an eligible claim to the Disputes Tribunal, or report potentially misleading conduct to the Commerce Commission.

Privacy complaints may be referred to the Office of the Privacy Commissioner.

17. Governing law

These terms are governed by New Zealand law.

Disputes may be considered by the New Zealand courts or another body with jurisdiction, including the Disputes Tribunal.

18. Changes and enforceability

We may update these terms by publishing a revised version with a new date.

The terms applying to an order are those in force when the order is accepted. Later changes do not retrospectively reduce your rights.

If a provision is unenforceable, the remaining provisions continue to apply where they can lawfully operate independently.

A failure to enforce a provision on one occasion does not automatically waive the right to enforce it later.
